These Terms of Service ("Terms") govern your access to and use of the website at brightharbor.us, the Bright Harbor platform, and the disaster recovery and insurance navigation services provided by Bright Harbor, Inc. ("Bright Harbor," "we," "our," or "us"). Please read these Terms carefully before using our Services.
By creating an account, subscribing to a plan, or using any part of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services. These Terms constitute a legally binding agreement between you and Bright Harbor, Inc.
Bright Harbor provides disaster recovery case management and insurance navigation services for homeowners and families affected by natural disasters. Our Services include: insurance claim review and documentation support; advocacy and communication with insurance carriers on your behalf; guidance and assistance with FEMA Individual Assistance applications, SBA disaster loan applications, and state and local aid programs; contractor verification services; temporary housing expense tracking; and access to a case management dashboard.
Important limitation: Bright Harbor is not a licensed public adjuster, insurance company, law firm, or government agency. Our Services constitute advocacy, case management, and informational support. We do not provide legal advice, insurance brokerage services, or financial advice. We are not attorneys and cannot represent you in litigation or formal legal proceedings. When your situation requires a licensed professional (public adjuster, attorney, financial advisor), we will identify that need and refer you appropriately.
We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services except as required by law.
To access most features of our platform, you must create an account. You must be at least 18 years of age and a resident of the United States to use our Services. By creating an account, you represent and warrant that you meet these eligibility requirements.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify us at help@brightharbor.us if you suspect unauthorized access to your account.
We reserve the right to refuse service, terminate accounts, or remove content at our discretion, particularly where we have reason to believe that information provided is inaccurate or that these Terms have been violated.
Bright Harbor offers subscription-based service plans as described on our Pricing page at brightharbor.us/price.html. The specific services included in each plan, monthly fees, and additional service fees are described on that page. Plan details and pricing are subject to change with 30 days' written notice to active subscribers.
Billing and payment: By subscribing to a paid plan, you authorize Bright Harbor to charge your designated payment method for the applicable fees. Monthly plans are billed on the same date each month corresponding to your original subscription date. Annual plans are billed annually on the subscription anniversary date. You are responsible for providing current, valid payment information and for all applicable taxes.
Failed payments: If a payment fails, we will attempt to reprocess the charge up to three times over seven days. If the charge continues to fail, your account may be suspended until payment is resolved. We will notify you by email of failed payments.
Refund policy: Monthly subscription fees are non-refundable once a billing period has begun. If you cancel your subscription, you will retain access to the Services through the end of your current billing period. For annual subscriptions cancelled within the first 14 days, we will refund a pro-rated amount for unused months minus one month's equivalent fee for the services rendered. Annual subscriptions cancelled after 14 days are non-refundable. One-time case fees are non-refundable once work has commenced.
Cancellation: You may cancel your subscription at any time through your account settings or by emailing help@brightharbor.us. Cancellation takes effect at the end of the current billing period. We do not charge cancellation fees.
To provide our Services effectively, you grant Bright Harbor authority to act as your recovery advocate. This includes: communicating with your insurance carrier regarding your claim; submitting applications to FEMA, the SBA, and state and local assistance programs on your behalf; requesting and reviewing claim-related documents from third parties with your authorization; and communicating with contractors, public adjusters, and other recovery professionals you direct us to engage.
You agree to provide accurate and complete information necessary for us to assist you, including insurance policy documents, claim correspondence, damage photographs, contractor estimates, and government program notices. Providing false or misleading information that affects your insurance claims or government program applications may constitute fraud and could result in program disqualification, civil liability, or criminal prosecution under applicable laws.
You remain responsible for all final decisions regarding your recovery, including acceptance or rejection of settlement offers, decisions to pursue legal action, and contractor selection. Bright Harbor's role is advisory and supportive — we provide information, analysis, and advocacy, but we do not make binding decisions on your behalf without your explicit direction.
You agree to use our Services only for lawful purposes in connection with legitimate disaster recovery needs. You must not: use our Services to submit fraudulent insurance claims or government assistance applications; provide false information about the nature, extent, or cause of property damage; use our platform to impersonate another person or misrepresent your identity; attempt to access another user's account or data without authorization; use automated means to access our Services except through our officially supported API; reverse engineer, decompile, or disassemble any portion of our platform; or use our Services in any manner that could damage, disable, or impair the platform or interfere with other users' access.
Violation of these acceptable use standards may result in immediate account suspension or termination, reporting to law enforcement authorities where required, and legal action for damages. We cooperate fully with law enforcement investigations involving fraudulent disaster claims.
Bright Harbor owns all rights, title, and interest in and to the Services, including all software, algorithms, documentation, templates, and platform features. Nothing in these Terms grants you any ownership interest in our intellectual property. You receive only a limited, non-exclusive, non-transferable license to access and use the Services for your personal disaster recovery purposes during your subscription term.
The content you upload to our platform (your documents, photographs, correspondence) remains your property. By uploading content, you grant Bright Harbor a limited license to process, store, and use that content solely for the purpose of providing our Services to you. We do not use your personal case content for marketing, resale, or purposes unrelated to your case without your explicit consent.
Service disclaimer: Our Services are provided "as is" and "as available." We do not guarantee any specific outcome regarding your insurance claim, government assistance application, or recovery timeline. Insurance settlement outcomes depend on your policy terms, the specific facts of your loss, your insurer's practices, and factors outside our control. Government assistance program eligibility and award amounts are determined by the applicable agencies, not by Bright Harbor.
No guarantee of results: Historical outcomes for other clients do not guarantee similar results for you. When we cite data about typical recovery improvements, those figures reflect broad averages across many cases and do not represent a guarantee or warranty for your specific situation.
Limitation of liability: To the maximum extent permitted by applicable law, Bright Harbor's total liability to you for any claim arising under these Terms or relating to the Services shall not exceed the fees you paid to us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or reputational harm, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for consequential damages, so the above limitations may not apply to you in their entirety. Nothing in these Terms limits our liability for gross negligence, willful misconduct, or fraud.
You agree to indemnify and hold harmless Bright Harbor, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: your use of the Services in violation of these Terms; your provision of false or misleading information in connection with your case; your violation of any applicable law in connection with your insurance claim or government assistance application; or any third-party claims arising from actions you direct Bright Harbor to take on your behalf.
By you: You may terminate your account at any time by contacting us at help@brightharbor.us. Upon termination, your right to access the Services ceases immediately, though you may request a copy of your case files within 30 days of termination.
By us: We may suspend or terminate your account immediately if you violate these Terms, provide fraudulent information, fail to pay fees after reasonable notice, or if we are required to do so by law. We may also terminate accounts for inactivity after a period of 24 months. Upon termination for cause, you forfeit any pre-paid subscription fees. We will provide notice of termination except where circumstances require immediate action.
These Terms are governed by the laws of the State of Colorado without regard to its conflict of law principles. You agree that any dispute arising from these Terms or the Services shall first be addressed through good-faith negotiation. Contact us at help@brightharbor.us to initiate a dispute resolution process.
If a dispute cannot be resolved through negotiation within 60 days, it shall be submitted to binding arbitration under the American Arbitration Association's Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration. This arbitration agreement does not apply to claims for injunctive relief or claims you bring in small claims court for matters within that court's jurisdiction. The arbitration shall take place in Denver, Colorado, or by remote means.
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect by email (for registered users) and by posting updated Terms on our website. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Services and cancel your subscription before the effective date.
Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bright Harbor regarding the Services and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will remain in full force and effect.
No waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing signed by an authorized Bright Harbor representative.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. Bright Harbor may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
